2. About the Site

Top Birthday Parties is an online directory operated by Beacon Directories, LLC as part of the Beacon Directories network. The Site lists venues, provides editorial descriptions, and offers tools that help visitors contact venues to inquire about hosting events.

3. Nature of Listings

  • Beacon Directories, LLC does not own, operate, or control the venues listed on the Site. Listings are informational and are not endorsements, recommendations, or guarantees.
  • Venue details — including capacity, pricing, hours, contact information, and amenities — are gathered from public sources and may be incomplete, outdated, or inaccurate. You should verify any detail directly with the venue before relying on it.
  • Inclusion or exclusion of a venue does not reflect any judgment about the venue's quality or fitness for a particular event. Editorial selection is at our discretion.
  • We may add, remove, modify, or re-rank listings at any time without notice.

4. Lead Submissions and Communications

The Site offers a quote request form on every venue page. By submitting that form, you understand and agree that:

  • You are directing Beacon Directories, LLC to forward your contact information and event details to the venue you selected so the venue can respond to your inquiry.
  • The venue, not Beacon Directories, LLC, is responsible for responding, providing pricing, fulfilling any booking, and complying with applicable consumer-protection rules in any communications it sends you.
  • Beacon Directories, LLC does not guarantee that any venue will respond, that pricing or availability quoted by the venue will be accurate, or that any event will be successfully booked.
  • You represent that the information you submit is accurate and that you are authorized to provide the contact details (e.g., the phone number and email) you supply.
  • If you check the consent box on the quote request form, you also consent to be contacted by Top Birthday Parties and the selected venue by phone, email, or text message at the contact details you provide, including via automated technology where applicable. Consent is not a condition of any purchase. Standard message and data rates may apply. You may opt out at any time by replying STOP to texts or by contacting the venue directly.

5. Claim Listings

The Site offers a claim form so a venue's owner or authorized representative can request control over the venue's listing. By submitting a claim, you represent that you are an owner, manager, or officially authorized agent of the venue. Beacon Directories, LLC may, at its discretion, verify claims, request supporting documentation, refuse claims, revoke claims later if information turns out to be inaccurate, or refer suspected fraudulent claims to appropriate authorities. Submitting a false or unauthorized claim is prohibited.

6. Venue and City Suggestions

The Site offers forms to suggest a venue or a city. Submissions are non-confidential and may be used by Beacon Directories, LLC to inform editorial decisions, with no obligation to list any suggested venue or to compensate the submitter. By submitting a suggestion, you grant Beacon Directories, LLC a perpetual, royalty-free license to use the information you provide for editorial and operational purposes.

7. Intellectual Property

  • Site content — including editorial descriptions, layout, graphics, logos, code, and the Top Birthday Parties name — is owned by Beacon Directories, LLC or its licensors and is protected by copyright, trademark, and other laws.
  • You receive a limited, revocable, non-exclusive license to view the Site for personal, non-commercial use.
  • Venue names, logos, and photographs depicting third-party venues remain the property of their respective owners.
  • You may not scrape, crawl, copy, republish, redistribute, frame, or create derivative works from any portion of the Site without prior written permission from Beacon Directories, LLC.

8. Prohibited Conduct

You agree not to:

  • Use the Site or any of its forms to send spam, harass venues, submit false or impersonating contact information, or otherwise act in bad faith.
  • Use any automated tool to scrape, crawl, harvest, or extract data from the Site.
  • Attempt to interfere with the Site's operation, security, or availability, including by probing for vulnerabilities or sending excessive traffic.
  • Impersonate Beacon Directories, LLC, any venue, or any other person.
  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation, including telemarketing, anti-spam, and consumer-protection laws.

9. Third-Party Sites and Services

The Site links to venue websites, mapping services, and other third-party properties, and uses third-party services such as Formspree (forms) and Google Analytics (analytics). Beacon Directories, LLC does not control these third parties and is not responsible for their content, practices, or terms. Your use of any linked site or third-party service is at your own risk and subject to that party's terms and policies.

10. Disclaimers

THE SITE AND ALL CONTENT, LISTINGS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACON DIRECTORIES, LLC DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OR COMPLETENESS OF VENUE INFORMATION.

Beacon Directories, LLC does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, and does not warrant the conduct of any venue or third party with whom you communicate through the Site.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Beacon Directories, LLC is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Site, including lost profits, lost data, lost opportunities, or damages arising from any event you book or attempt to book through a listed venue.
  • Beacon Directories, LLC's total aggregate liability for any claim arising from or related to the Site or these Terms is limited to one hundred U.S. dollars ($100).
  • These limitations apply regardless of the legal theory asserted (contract, tort, statute, or otherwise) and even if Beacon Directories, LLC has been advised of the possibility of such damages.

12. Indemnification

You agree to defend, indemnify, and hold harmless Beacon Directories, LLC and its officers, members, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, your violation of any law, or your infringement of any third-party right, including any false or unauthorized claim, suggestion, or quote request you submit.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Nebraska, without regard to conflict-of-laws principles. The exclusive venue for any dispute arising out of or relating to these Terms or the Site shall be the state or federal courts located in Nebraska, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

Beacon Directories, LLC may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the Site after any change constitutes acceptance of the updated Terms.
